NORWICH — A judge will allow jurors to hear a dying victim’s identification of his alleged shooter at Stancovitch Fabre’s forthcoming murder trial, The Day reported October 15.
New London Superior Court Judge Elizabeth Leaming rejected a defense request to exclude the statements, finding they qualified for the dying-declaration exception to the hearsay rule, according to the newspaper’s account of Thursday’s hearing.
Fabre, 22, is accused of shooting Camaury Norman-Clack, 19, outside a Norwich apartment complex on May 10, 2023. Defense attorney Ted Koch argued that the victim expected to survive rather than believed death was imminent, The Day reported.
The ruling concerns evidence jurors may consider; it does not establish Fabre’s guilt. Jury selection is scheduled for October 27, the newspaper reported.
